Marketing en GDPR; Wat mag nu wél nog inzake prospectie en direct marketing?

Vermits de Directie van de Belgische Data Privacywaakhond, de Gegevensbeschermingsautoriteit (vroegere privacy commissie) pas recent werd aangesteld, zijn er in België nog maar weinig richtinggevende beslissingen te rapen. In een aantal buurlanden (Frankrijk, Nederland, ..) des te meer. En ook het Europees Hof van Justitie en de European Data Protection Board zaten niet stil.

Kortom, voldoende richtsnoeren om als handvaten te dienen.

We focussen ons in het bijzonder op marketing omdat dit cruciaal onderdeel van ieder bedrijf het meest impact heeft ondervonden van de GDPR en ook vaak voorwerp is van sancties in onze buurlanden.

We benaderen dit onderwerp vanuit de verschillende cruciale aspecten van marketing:

  • welke adressenbestanden (mail en andere) kan ik nu wél of niet meer gebruiken?
  • wat moet er zeker in mijn privacy policy instaan?
  • baseer ik mijn hele privacybeleid op toestemming ("consent") of zoek ik naar meer rechtvaardigingsgronden?
  • kan ik persoonsgegevens zoals e-mailadressen of gsm-nummers of andere gegevens delen met andere ondernemingen van dezelfde groep én ook met derden?
  • wat moet ik doen om geolocalisatie, profiling, algoritmes, AI, .. te gebruiken om de customer experience te optimaliseren?
  • hoe zit dat nu juist met die vervelende cookies?
  • wat te verwachten van de regelgeving inzake E-privacy?

De benadering van dit seminarie is vooral juridisch van aard, maar we geven ook een aantal tips mee vanuit IT-security zodat ook daar de voornaamste aandachtspunten worden geschetst.

De General Data Protection Regulation (afgekort GDPR) omvat een ingrijpende wijziging inzake data en privacy die van kracht wordt op 25 mei 2018. Verneem hoe deze Europese regelgeving ook uw HR-departement sterk zal beïnvloeden. Binnen de HR-wereld leven er vele vragen omtrent deze nieuwe regelgeving zoals bijvoorbeeld:

  • mag u sollicitanten screenen via hun Facebook-profiel?
  • moet u CV’s van niet weerhouden sollicitanten vernietigen of mag u ze nog bijhouden?
  • welke personeelsgegevens dient u op te lijsten in het Register van Verwerkingsactiviteiten?
  • brengt de nieuwe richtlijn ook nieuwe verplichtingen met zich mee inzake uw cameratoezicht?
  • bent u verplicht een DPO aan te stellen?

This to complement the whistleblower tools recently set up by European and Belgian authorities.

 

All businesses will benefit from setting up a private dedicated whistleblowing channel or an ethical hotline, as effective tool to detect fraud or unethical behavior by an employee, company director or external service provider.

 

This workshop aims at providing answers to the following questions: How can whistleblowing procedures be implemented in a cost-effective manner? How to protect whistleblowers? What other quality standards apply to whistleblowing procedures? How to deal with accessibility, confidentiality, anonymous disclosures, interactive hotlines, language, security, labour law, privacy and GDPR?

Belgian Parliament is expected to vote later this week on new rules on flexible working which will directly affect the HR policies of many companies operating in Belgium. Amongst others, the rules on variable part-time work, on flexible working schemes and occasional working from home will be modified. The modifications will require changes to work rules, company policies and employment contracts. Moreover the new rules will have retroactive effect from 1 February 2017. During this seminar we will also touch upon some other topics that are relevant for HR practitioners such as: granting cost allowances as well as guidelines on how to avoid abusive dismissal.

 

Our labour law partner Dylan Casaer will guide you through these new rules and will provide you with hands-on advice.
